Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Loclbee’s websites, applications, and restaurant operations platform (the “Service”). By creating an account or using Loclbee, you agree to these Terms.

1. Who may use Loclbee

You must be at least 18 years old (or the age of legal majority where you live) and able to form a binding contract. If you use Loclbee on behalf of a restaurant or company, you represent that you have authority to bind that entity, and “you” includes that entity.

2. Accounts and workspaces

You are responsible for maintaining the confidentiality of your login credentials and for activity under your account and restaurant workspaces. You must provide accurate information and promptly update it. You may invite team members and assign roles; workspace owners and admins are responsible for permissions and for content created in the workspace.

3. The Service

Loclbee provides tools for restaurant operations such as POS, orders, kitchen displays, inventory, recipes, menus, QR ordering, staffing, and reporting. Features may change as we improve the product. We may add, modify, or discontinue features with reasonable notice when practicable.

4. Subscriptions, trials, and billing

Paid plans are billed according to the pricing shown at signup or in your billing settings (monthly, yearly, or custom enterprise arrangements). Free trials, when offered, convert to a paid subscription only when you complete checkout or as otherwise stated at the time of trial. Fees are generally non-refundable except where required by law or as described in our Refund Policy. Taxes may apply. Failure to pay may result in suspension or termination of access.

5. Acceptable use

You agree not to misuse the Service. Prohibited conduct includes:

  • Violating laws or third-party rights.
  • Uploading malware, attempting unauthorized access, or disrupting the Service.
  • Scraping, reverse engineering, or reselling the Service except as expressly allowed.
  • Using Loclbee to process unlawful transactions or content.
  • Sharing accounts in a way that bypasses seat, role, or security controls.

6. Your content

You retain ownership of menus, logos, order data, and other content you submit (“Customer Content”). You grant Loclbee a limited license to host, process, display, and back up Customer Content solely to operate and improve the Service. You represent that you have the rights needed to use Customer Content in Loclbee.

7. Intellectual property

Loclbee and its logos, software, design, and documentation are owned by Loclbee or its licensors. These Terms do not grant you any right to use our trademarks except as needed to identify your use of the Service in a truthful way.

8. Third-party services

The Service may integrate with third parties such as Stripe (payments), chat providers, hosting, or media storage. Your use of those services may be subject to their terms. Loclbee is not responsible for third-party services we do not control.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, or that the Service will meet every operational need of your restaurant.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOCLBEE AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO LOCLBEE FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

11. Indemnification

You will defend and indemnify Loclbee against claims arising from your Customer Content, your use of the Service in violation of these Terms, or your violation of law or third-party rights.

12. Suspension and termination

You may stop using Loclbee at any time. We may suspend or terminate access for non-payment, security risk, or material breach of these Terms. Upon termination, your right to use the Service ends. Provisions that by nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive.

13. Governing law

These Terms are governed by the laws applicable in the jurisdiction where Loclbee principally operates, without regard to conflict-of-law rules, except where mandatory local consumer laws provide otherwise. Courts in that jurisdiction will have exclusive venue for disputes, subject to applicable law.

14. Changes

We may update these Terms by posting a revised version. Material changes will be indicated by updating the “Last updated” date. Continued use after the effective date constitutes acceptance where permitted.
